TERMS OF SERVICE

Zouk Island is organized by Higher Life Co., Ltd, a company incorporated in Thailand and based on the island of Koh Phangan, at the service of bringing people together through the power of wellness and dance.
Zouk Island brings this mission to life through several programs, including but not limited to Zouk Island Festival, Zouk Island Month, and Zouk Island Marathon (individually an "Event" and collectively the "Events").
By visiting our website, participating in an Event, purchasing or accepting a pass for any Zouk Island Event ("Zouk Island"), you ("you") engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms").
These Terms of Service apply to all users of the site, including without limitation users who are browsers, customers, vendors, merchants, and/or contributors of content, and apply equally across all Zouk Island Events unless a specific Event's own materials state otherwise.
Please make sure you understand the terms you are agreeing to before participating in any Zouk Island Event.
1. General Conditions
We reserve the right to refuse service to anyone for any reason at any time.
A breach or violation of any of the Terms will result in immediate termination of your participation in the Event.
All participants are requested to strictly follow the rules of the venue at all times.
All Zouk Island staff members will be visibly identified with T-shirts and/or credentials.
2. Actions that Legally Bind You to the Terms of this Contract
When you purchase a ticket or pass for a Zouk Island Event, a contract exists once Zouk Island issues a written confirmation after receipt of the applicable package. Please check your confirmation carefully and report any incorrect or incomplete information to Zouk Island immediately. Please ensure that names are exactly as stated in the relevant passport.
If you receive a Complimentary ticket pass and participate in an Event, you are bound to the Terms when Zouk Island confirms your participation by issuing you an Event bracelet.
If you purchase a ticket on behalf of other participants, you guarantee that you have the authority to accept, and do accept, these Terms on behalf of the other participants in your party.
You must be at least 18 years of age to purchase a ticket and/or to participate in any Zouk Island Event.
3. Tickets, Changes, Refunds, & Transfers
Ticket options may offer packages with or without accommodation included, and may vary by Event (e.g., single-day passes, weekly passes, full Month passes, Marathon passes, or Festival passes).
Ticket prices are subject to change without notice.
All tickets are non-refundable but are transferable unless otherwise noted.
Transfers of titularity can only occur until 15 days before the relevant Event starts. You must submit a request through our Contact form and receive approval from the organization. After this date, no tickets will be transferred.
You may not sell a ticket for more than you paid, or profit in any way from purchasing and reselling tickets. Doing so may result in a ban from our Events and cancellation of your tickets.
Complimentary Ticket passes are neither saleable nor transferable.
If you purchase a ticket with an accommodation package, note that a hotel room can only be shared among two people. No more than two individuals may sleep in a room. You must follow the guidelines of the accommodation provider.
4. Event Venue & Accommodation Package
Zouk Island Events take place on Koh Phangan, Thailand, with the specific venue(s) communicated ahead of each Event (for example, the Haad Yao Bayview Resort, Haad Yao beach, Surat Thani District).
Event activities may take place across different locations within the venue and its surroundings. Signage will support navigation to workshop rooms and activity areas.
Accommodation tickets, where offered, are provided by the relevant accommodation partner. Check-in is generally at 14:00 PM on your arrival date, and check-out is by 11:00 PM on your departure date. Be attentive to the published schedule so you coordinate your arrival and don't miss any activity.
If you plan to arrive early or extend your stay, you must contact the accommodation provider directly and request a booking. Show your Event ticket confirmation, and they will try to offer the same rate agreed for Event participants, which is typically more affordable than regular high-season rates.
5. Workshops & Program Levels
Zouk Island Events generally offer multiple tracks, such as Open Level and Intermediate/Advanced (levels and structure may vary by Event - for example, Zouk Island Month may include Intensive and Advanced weeks, and Zouk Island Marathon may run its own dedicated format).
Open-level classes are open to participants of any level.
To take Intermediate/Advanced workshops, you must already be able to lead and/or follow: Basic step, Lateral, Viradinha, Elastico/Rau, Io-io, Soltinho, Lunge, Simple Turn, Chicote, Cambre, Bonus, and basic variations of Balão, tilted turns, and rotisserie.
The experience of all participants and teachers is best when students take classes at an appropriate level. If you have not already learned the above, please do not join the Intermediate/Advanced track. We will not check participants' level in advance, but staff may ask you to stay in the Open Level track if it becomes clear you are not prepared for the Intermediate/Advanced track.
Tracks, weeks, and program structure are subject to change without notice.
6. Health, Safety, And Mandatory Insurance Requirements
To ensure the safety of all participants, if your country of residence is outside of Thailand, travel insurance is required to attend any Zouk Island Event.
Proof of insurance is required within 1 week before the Event start date.
You must possess travel insurance with a minimum medical, evacuation, and repatriation coverage of $100,000 USD, covering all applicable dates of the Event.
You may purchase travel insurance or activate it through the benefits of your credit card. The insurance must cover personal injury and emergency medical expenses, including coverage in case you contract COVID.
You are strongly recommended to extend your coverage to include "Cancel for Any Reason" protection, covering cancellation, curtailment, and other expenses arising from loss, damage, injury, delay, or inconvenience while traveling.
It is your responsibility to ensure you have sufficient coverage and comply with the terms of your applicable insurance plans. Zouk Island is not a travel insurance provider and is not responsible for the specific terms of your policy. Insurance reimbursement is not within Zouk Island's control, and this information does not constitute insurance advice. Please consult an insurance professional and understand your policy's coverage limits.
7. Package Exclusions
Zouk Island Event packages do NOT include the following, unless explicitly stated:

International or domestic airfare

Entry visa to Thailand

Passport (must be valid for at least 6 months after departure date)

Mandatory insurance (as stated in Section 6 above)

Transportation from the port of arrival to the Event location

Negative COVID test result, if required by airport authorities upon entry/exit of your home country or Thailand
8. Code of Conduct
Zouk Island strives to provide a safe, comfortable learning and social environment for everyone who joins any of our Events. Behavior that makes others feel uncomfortable or unsafe will not be tolerated. If we find that someone is violating our code of conduct, we reserve the right to terminate their participation and access to the Event without a refund. We kindly ask you to follow our code of conduct guidelines:
Be kind and respectful to the Support Team

Be polite to all Zouk Island staff and support team. It's a huge co-creation effort to bring each Event alive, from the front desk of the venue all the way to the artists and DJs who make it shine.

In the workshops, pay attention when an artist is talking and don't distract others.

Mute your cell phone before workshops. If it rings during a workshop, go mute it.

Don't put your drink or anything else on the DJ table. Don't distract the DJ.
Respect other dancers
-
Maintain good hygiene. Clean your body, wear deodorant, wear clean clothes, and change when necessary.

Keep your partner's safety in mind at all times. Do not initiate movements you cannot execute safely. Pay attention to your surroundings to avoid running into others.

Respect your partner's boundaries. If a partner asks you verbally or physically not to do something, don't do it. If a person physically resists your efforts to get closer to them, respect that distance.

You are free to ask anyone for a dance and to say yes or no to anyone for any reason. You are also free to stop a dance at any time for any reason. If someone declines your request to dance or stops a dance, respect their decision and don't take it personally.
Harassment will not be tolerated. Harassment includes but is not limited to:

Making sexual or vulgar remarks

Uninvited, unwanted touching
-
Pressuring someone to accept a social media request or give their phone number
-
Sending unwanted messages to other participants, or any form of stalking
-
Pressuring someone to dance, or repeatedly asking someone who has already refused
-
Violent or disorderly behavior
-
Verbal abuse or bullying
If you feel another participant is putting you into an unsafe or unwanted situation, we encourage you to:

Tell the other person directly that you do not want the behavior to continue.
-
If the behavior continues or escalates, tell a staff member.
Respect the venue and Thai culture and standards We appreciate the support of our venues in the realization of our Events, and we hope to maintain good relationships for future editions. Please help us take care of the venue. If you see any of the below, please tell a staff member immediately.

Be respectful of Thai culture, and mindful of your dress code in public spaces.

Do not damage, tamper with, or misuse any equipment in the venue.

If you are a smoker, please go outside the building to avoid disturbing others.
-
Do not bring or use any illegal drugs in or around the venue.
-
Do not become overly intoxicated. If you cannot take care of yourself, or are causing a disturbance or endangering others, we may ask you to leave, and we may ban you from other nights/future Events.

Take care of your own trash. You may bring outside snacks/drinks, but please dispose of or take with you everything you bring in. If you spill something, clean it up.
-
If police or other authorities come to check the venue, be respectful and do not give them any reason to cause problems for us.
9. Acceptance of Risk and Your Responsibilities
You acknowledge that Zouk Island Events consist of physically, mentally, and emotionally demanding activities and may involve a degree of risk to your health and safety, carrying the potential for injury, death, and property loss.
You acknowledge it is your responsibility to care for yourself and ensure appropriate sleep, hydration, and nourishment, and not to become intoxicated to the point of being a hazard to yourself or others.
You acknowledge that you will be participating in parties and activities featuring disorienting conditions, including but not limited to: loud music, bright lights, very dim light, and people moving unpredictably. Risks include, but are not limited to:

Injury while training, exercising, dancing, or performing another activity

Contraction of contagious illness
-
Consequences of dehydration, malnourishment, and sleep deprivation
-
Actions of other people, including participants, event staff, instructors, venue staff, and/or producers of the Event
You hereby assume all risks of participating in any Zouk Island Event. You certify that you are physically, emotionally, and mentally fit, have sufficiently trained for participation, and have not been advised otherwise by a qualified medical authority.
To participate, Zouk Island requires that you confirm your assumption of this responsibility by completing the participation waiver (the "Waiver") prior to the Event start.
You agree that Zouk Island is not responsible for providing information or guidance regarding local customs, weather conditions, specific safety concerns, physical challenges, or laws in effect at the Event location. You acknowledge that you have considered the potential risks, dangers, and challenges, as well as your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.
You must at all times strictly comply with all applicable laws and regulations of the Kingdom of Thailand. Should you fail to comply, commit any illegal act, or should your behavior (in the reasonable opinion of Zouk Island) cause or be likely to cause danger, distress, or material annoyance to others, the organization may terminate your participation. You will not be entitled to any refund for unused or missed services, or costs incurred as a result of termination of your travel arrangements, including without limitation return travel, accommodation, meals, and incidentals.
You are responsible for any costs (including repair, replacement, and cleaning fees) incurred by Zouk Island or its suppliers for property damage, destruction, or theft caused by you while attending an Event. You agree to immediately report any pre-existing damage to a Zouk Island representative and the relevant venue/accommodation/transportation staff as soon as possible upon discovery.
You agree to take all prudent measures relating to your own safety while attending an Event, including but not limited to the proper use of safety devices and obeying all posted signs and oral or written warnings regarding health and safety. Neither Zouk Island nor its Third Party Suppliers (as defined below) are liable for loss or damages caused by your failure to comply with safety instructions or warnings.
You agree to bring any complaints to Zouk Island staff as soon as possible, so we have the opportunity to properly address them. Zouk Island assumes no liability for complaints that are not properly brought to our attention, and cannot resolve or attempt to resolve complaints until proper notice is provided.
Accident Waiver and Release of Liability (AWRL)
I acknowledge that this Accident Waiver and Release of Liability (AWRL) will be used by Zouk Island for any Event in which I participate, and it will govern my actions and responsibilities.
In consideration of my application and being permitted to participate, I hereby, for myself, my executors, administrators, heirs, next of kin, successors, and assigns:
(A) Waive, release, and discharge from any and all liability for my death, disability, personal injury, property damage, property theft, or actions of any kind that may hereafter accrue to me, or to my traveling to and from the Event, the following entities or persons: Zouk Island, and its directors, officers, employees, volunteers, representatives and agents, Event sponsors, and Event volunteers.
(B) Indemnify and hold harmless all entities or persons mentioned above from any and all liabilities or claims made by other individuals or entities as a result of my actions during the Event.
I hereby consent to receive medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during the Event.
This AWRL shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
A copy of this AWRL is included with every pass. By participating in any Event, the participant certifies that they have read this document and understand its content.
10. Changes to Schedule
You acknowledge that the nature of Zouk Island Events requires flexibility, and you agree to permit reasonable changes to schedules, services, or itineraries. Schedules, accommodations, workshops, activities, and amenities are subject to change without notice due to unforeseeable circumstances or events outside the control of Zouk Island (including but not limited to Force Majeure, illness, mechanical breakdown, flight cancellations, strikes, political events, and entry or border difficulties).
11. Third Party Suppliers
Zouk Island makes arrangements with artists, venues, accommodation providers, vendors, photographers, wellness practitioners, transfer operators, tour and local guides, and other independent parties ("Third Party Suppliers") to provide you with the best possible experience across our Events.
Third Party Suppliers may also engage local operators and sub-contractors. Zouk Island cannot be responsible for their acts or omissions.
Any services provided by Third Party Suppliers are subject to their own terms and conditions, and their liability is limited by their tariffs, conditions of carriage, tickets, vouchers, and applicable international conventions and agreements. These may limit or exclude the liability of the Third Party Supplier.
You acknowledge that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate. If an artist, guest facilitator, or any Third Party Supplier is unable to attend an Event and perform their duties, Zouk Island has the right to replace them. Zouk Island is not liable and will not assume responsibility for any claims, losses, damages, costs, or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress, or frustration, whether physical or mental, resulting from the act or omission of any such party.
12. In Case of Cancellation of an Event
Zouk Island may cancel or postpone any Event for any reason. If an Event is canceled, Zouk Island will refund 100% of the ticket price. In case of any cancellation for any reason, we are not responsible for any incidental expenses you may have incurred as a result of your purchase, including but not limited to visas, vaccinations, unfavorable exchange rate fluctuations, travel insurance excess, or non-refundable flights.
Zouk Island shall not be liable for any failure or delay in fulfilling its services when caused by circumstances beyond its reasonable control, including without limitation the following Force Majeure Events: (a) acts of God; (b) flood, fire, earthquake, pandemics, epidemics, drought, bushfire, storm, or other natural disaster, explosion, or public health and safety emergency; (c) war, invasion, hostilities, terrorist threats or acts, riot, or other civil unrest; (d) government order, law, or actions; (e) embargoes or blockades; (f) national or regional emergency; (g) strikes, labor stoppages, or slowdowns; (h) shortage of adequate power or transportation facilities; (i) other events beyond the reasonable control of the organization.
Where cancellation is due to such external events, Zouk Island will reschedule the Event to a future date and provide written notice. If an Event is postponed, your purchase and payments will transfer to the new dates. If you are unable to attend the new dates and wish to cancel, you will be entitled to a full refund of the purchase amount, paid through the original payment method.
Zouk Island shall not be liable for any loss or damage suffered by you as a result of a Force Majeure Event and/or the cancellation of an Event due to a Force Majeure Event, including incidental expenses or consequential losses such as visas, vaccinations, non-refundable flights or rail, non-refundable parking or other fees, loss of earnings, or loss of enjoyment.
13. Media Policy
Brazilian Zouk and social dance in general thrive on pictures and videos. You agree that, while participating in an Event, images, photos, or videos may be taken by other participants, Zouk Island, or its representatives, and may feature you. We hope you will also help us by sharing and tagging us on social media.
Media Release By participating in a Zouk Island Event, you agree to allow photos/videos of your likeness to be captured by Zouk Island's official media staff and approved vendors during all parties, workshops, and outside activities. You grant a perpetual, royalty-free, worldwide, irrevocable license to Zouk Island, its contractors, sub-contractors, and assigns, to reproduce this content for any purpose whatsoever (including marketing and promotions for future Zouk Island Events), in any medium whatsoever, whether currently known or hereinafter devised, without further obligation or compensation payable to you.
You are free to download and use/post any pictures of yourself that Zouk Island holds the rights to and publishes online (please tag/mention the photographer and Event). If pictures are posted by an independent photographer, please contact them before using their photos commercially. If an approved vendor offers videos/photos for sale, you can contact them directly to purchase that media.
No Media Bracelet If you prefer not to be photographed or recorded, you can request a No Media bracelet. Our media staff will be instructed to avoid recording anyone wearing this bracelet. We may still capture you peripherally in videos and photos, but we will not capture or post anything focused on you specifically.
Asking to Not Be Photographed or Recorded If anyone is taking pictures or recording you and you want them to stop, make a stop sign with your hand, shake your head to say no, or verbally ask them not to record you. If someone gives you this sign while you're recording, respect it and leave them alone.
Asking for Media to Be Removed If there is a specific picture or video of yourself posted online that you want removed, please copy a link to the media and send it to the source that published it.
Purchasing Media Approved videographers may record participants' social dances during parties. These recordings will be available for purchase through their own channels; we will introduce videographers and share their contact information and pricing during the Event.
Recording Demos and Recaps Official videographers may professionally record demos and may move around during them. Participants may not move around while recording, or otherwise distract other participants, artists, or videographers.
Participants may record workshop recaps and occasional short clips during workshops, but may not record continually throughout a workshop. Class content is only for participants; only the recap portion is agreed to be recorded by the artists.
Recording/Posting Social Dances Record your friends and people who want to be recorded - many people enjoy having videos of themselves! However, they may not want them posted, so if you record someone, send them the video privately or get their consent before posting publicly. Do not get in the way of or distract people dancing.

15. Updates on Terms & Conditions
Zouk Island reserves the right to update and/or alter these Terms of Service at any time.
16. Governing Law
These Terms of Service shall be governed by the laws of the Kingdom of Thailand.

These Terms of Service apply across all Zouk Island programs, including Zouk Island Festival, Zouk Island Month, and Zouk Island Marathon. Where an individual Event publishes supplementary or Event-specific terms (e.g., specific dates, pricing, or venue details), those supplementary terms apply in addition to, and do not replace, this general Terms of Service.
